I am not sure exactly who told us we could not do this. I was talking to our organization president and she informed me that she had received a phone call from some government representative. I can't remember the specific source. The person did tell her that we might get sued for overtime wages by the people we select to live in the house. As we are new members of BCMA, I suggested we contact other members via Listserv and volunteered to initiate the process. I have been forwarding responses to our president and will be in touch with her tomorrow.

Thanks for your help.

Keith Johnston

On Thu, Jan 3, 2019 at 3:43 PM BC Museums Association - Member Broadcast Email Network <bcma-broadcast@lists.vifa.ca> wrote:

<span style="font-size:11pt;font-family:"Calibri","sans-serif";color:rgb(31,73,125)">Hi,

<span style="font-size:11pt;font-family:"Calibri","sans-serif";color:rgb(31,73,125)">

<span style="font-size:11pt;font-family:"Calibri","sans-serif";color:rgb(31,73,125)">I am a little surprised that someone said you can’t do this. We have done this and both CRA and Employment Standards are ok with it. You do have to provide a T4 for the value of the space, but the value can be reduced from market value if the space is compromised because of the issue of lack of privacy or other issues related to the use. You also have to pay the appropriate payroll expenses and the value of the rent has to be at least minimum wage for the services that you get from the person. Now perhaps the issue is that you are not providing the space year round (ours is), and with recent changes to lease rules? I am curious as to whom told you that it was not possible?

<span style="font-size:11pt;font-family:"Calibri","sans-serif";color:rgb(31,73,125)">

<span style="font-size:10pt;font-family:"Tahoma","sans-serif"" lang="EN-US">From:<span style="font-size:10pt;font-family:"Tahoma","sans-serif"" lang="EN-US"> bcma-broadcast-bounces@lists.vifa.ca [mailto:bcma-broadcast-bounces@lists.vifa.ca] On Behalf Of BC Museums Association - Member Broadcast Email Network
Sent: January 3, 2019 2:03 PM
To: bcma-broadcast@lists.vifa.ca
Subject: [BCMA Members Only] Looking for advice on how to employ a caretaker

At the Friends of Fintry we are wanting to bring on a caretaker to live in our house and take care of it during the off season.
