Jim gives good advice. Remember that you are dealing with bureaucrats
who are human (probably) and have families, mortgages, car loans, unwed
pregnant daughters, sick cats, leaky condos etc. They just have a job to
do.

If you apologize, claim ignorance rather than malicious intent, strive
to do it right from now on, cooperate and try to work with them, then
they will likely be reasonable. If you are argumentative and/or
obstructionist, then they will dig their heels in and play hard ball in
a game that you cannot win.=20

They appear to have wanted to put the fear of God into you which is
unusual as they should follow US President Teddy Roosevelt's advice of
"walk softly and carry a big stick", but remember that their role is to
see that the government gets its "pound of flesh" in the coin of the
realm. They have no need or desire for your collection - they want money
(accounts can't put artifacts in a spreadsheet financial report, only
dollars). If you follow Jim's advice, they will likely be willing to
discuss terms and schedules of payment, and who knows, maybe even
reduction of the amount - e.g. they likely have discretionary powers to
reduce or eliminate penalties as long as they get what is due to the

Whomever prepares your annual financial statements independently,

and/or prepares your payroll need(s) to be involved in this process

immediately to review the government assessment and to verify its

accuracy.

As long as you are responsive and cooperative throughout the process,
(and it will become a process), you should find the urgency (re: court
action and seizure of assets, etc) diminished somewhat as a solution or
ruling is worked out. This may include proposing an agreed

remittance schedule for the outstanding amount.

This sounds like alleged unremitted employee deductions, which are

required for all employees, FT, PT or temporary, (including those

summer students), who are clearly not contractors.

Small and even larger organizations can get confused as to what a

contractor really is, and may think they can avoid remitting

deductions by simply calling workers 'contractors', even though they

actually work like employees, (ie. regular hours of work &

employer-assigned tasks versus specific deliverables to deadline,

etc).

Canada Revenue Agency (CRA) has a specific publication available

online to help both employers and workers to determine their

All institutions are well-advised to review their employment /
contractor relationships for compliance, as well as for how your
contractors' contracts are worded. CRA can also be approached, and
advisedly prior to a proposed contracted or employment term, to advise
on which status would apply.

Through annual filing of T4 Summaries by employers, and personal tax

returns (with T4 slips), inevitably any outstanding remittances will

show up through such audits. In terms of contractors, employers should
also ensure whether GST applies to your contractor's fees.
