Hi Todd
The easy answer is yes, especially if you have the money for a lawyer.
We had a case where another family member, not the donor wanted a donation back. Under CRA rules you can't give it back if a donation agreement has been signed. They went to the Mayor and their Member of Parliament and called me an 'officious bastard' online. I didn't hear anything more after I responded to the MP citing CRA rules.
We did revamp our collections policy to meet CRA rules - without a legal review.
I would be interested in seeing your wording on CRA

Subject: [BCMA] Collections Policy Legal Advice
The Princeton and District Museum and Archives Society has spent a great deal of time and effort developing an updated Collection Policy. We took the best parts of all of the relevant Canadian documents we could find and combined this with guidance from the CRA (yes, we are a Charity). Knowing that the Collection Policy and the Society Bylaws are probably the two most important guiding documents in a Society like ours, and knowing that frequently, major changes to Bylaws are reviewed by a lawyer (with non-profit knowledge), would it be wise to have our new policy reviewed? What have you done in your environment?
